Workshop Terms and Conditions for End-Users

Parties

All workshops available on the website under domain name www.heartledpsychotherapy.com, (“Workshops”) are provided by Alexandra Dent Psychological Services Ltd (“ADPS”) to individual end-users on an exclusive-use basis. End-users subscribing for an account to use the Workshops should be 18 years old or over or should have obtained their parental or carer consent, prior to purchasing the Workshops.

Groups, companies and other organisations are prohibited from accessing these Workshops (and, for the avoidance of doubt, individual end-users should not share these Workshops with such groups, companies and organisations), unless they have first obtained the consent of ADPS on info@heartledpsychotherapy.com. Upon granting such consent, ADPS will specify the purchase price and terms of use for access to the Workshops by multiple end-users, which will differ from the terms below.

Throughout these terms and conditions, the terms “we”, “our”, and “us” will all be used with reference to ADPS. The terms “you” and “your” shall be used when referencing you, the end-user of the Workshops.

1. General

1.1 These terms and conditions establish the terms on which we supply you with your Workshop(s). All purchases of Workshops made from ADPS Ltd will be subject to these terms and conditions.

1. 2 When you register with us, you shall set up an account, through which you will gain access to the Workshops. Upon signing up for the account, you consent to these terms and conditions. You have an exclusive right to use your online account and you must not use your account improperly, for example by sharing your login details with a third party, including another individual or organisation. It is your responsibility to make sure you set up your own account properly and keep your login details safe as we may not be able to rectify any issues that arise from failure or mistakes when doing this.

1.3 Any information provided to us, such as your name, address, contact information, and bank details, should be as complete and up-to-date as possible at the time of submission. We will hold this information in accordance with Clause 7 (Personal Data Usage) below.

1.3 We reserve our right to suspend, withdraw, or otherwise terminate your account and access to our Workshops at any time in the event these terms and conditions are breached. We shall not terminate your account or withdraw access to a Workshop without due reason.

1.4 We reserve our right to alter, amend, or delete any information contained in our Workshops or found on our website at any time without notice.

2. Payments and Cancellation

2.1 A payment from you to ADPS for the Workshops serves as an agreement by you to, and an acknowledgment that you have read, these terms and conditions, in addition to your express acknowledgment of these terms of these terms and conditions when signing up for an account.

2.2 In the event you do not make a scheduled payment or your payment details are not updated, we reserve the right to immediately suspend access to your account and to the Workshops until the matter is rectified.

2.2 Given that you will have instant access to digital content upon payment for the Workshops, you agree to waive your right to cancel your purchase and to be refunded for your purchase, save in the case of an obvious defect present in the Workshops which is the fault of ADPS.

2.2 We reserve our right to adjust the pricing of our Workshops at any time.

2.3 Note that changes will not affect purchases made prior to the date of the changes.

2.4 Your statutory consumer rights remain unaffected by anything in our terms and conditions.

3. Service

3.1 ADPS has used best efforts to produce Workshops of the highest possible quality but does not make any representations or warranties with respect to the accuracy, applicability or fitness of the content within the Workshops.

3.3 The information contained in the Workshops is strictly for information and educational purposes only. Therefore, if you wish to use concepts or ideas contained within the Workshops, you take full responsibility for your actions.

3.3 ADPS (or any third party participants in the Workshops) shall not be held liable to any party for any direct, indirect, implied, punitive, incidental or other consequential damages arising directly or indirectly from any use of the material in the Workshops.

3.4 As in all cases, the end-user should never take any information in these Workshops at face value and should always do their own due diligence on any material in the Workshops to form their own opinions and best judgments.

3.5 The Workshop content is not intended to be a substitute for professional medical or psychological advice, diagnosis or treatment. Always seek the advice of your physician or therapist or other qualified health care provider with regards to any questions you may have regarding a psychological or medical condition. Never disregard medical or psychological advice or delay in seeking treatment because of something you have seen on these Workshops.

4. Intellectual Property Rights

4.1 Any intellectual property rights relating to Workshops are owned by ADPS who, upon receipt of your payment, grants you, the end-user, a licence to use the Workshops.

4.2 When purchasing a Workshop from ADPS, you are agreeing to not replicate, copy, modify, adapt, share or alter any part of the Workshop content. To do so would be to breach the licence granted to you for use by ADPS.

4.3 When you’re granted access to our Workshops, it’s your agreement that you will not share your login details with any third party, and that you will endeavour to keep them secure. You also agree to not willingly or knowingly share access to our Workshops with any third party organisation, entity, company or individual. If you do so, you accept the risk that your account may be suspended or terminated and ADPS reserves the right to recover any losses suffered by your breach.

5. Third Party Content

5.1 We may, on occasion, provide a link to or reference a third party website relevant to your Workshop content. Clicking these links or going to the third party website is your agreement that ADPS is not responsible for any content or materials found on those websites, and we will not be held responsible for anything that occurs as a result of visiting them.

5.2 ADPS will not be held responsible for any third party provided content. Any information taken from a third party site should be verified independently by you, as we offer no guarantees on its veracity or accuracy.

5.3 The privacy and security policies, as well as the terms and conditions, of third party websites may differ considerably from those of ADPS. It’s your responsibility to read, understand, and comply with any security and privacy policies as well and the terms and conditions of third party sites that you visit.

6. Liability Limitations

6.1 Losses arising directly as a result of our own negligence or errors, or for any other reasons, will be limited to the price of your Workshop. This doesn’t preclude liability for personal injury or death, fraudulent misrepresentation, any breach of the Consumer Protection Act 1987, or any other unlawful exclusions.

6.2 We will not be held liable for indirect damage or losses (including, but not limited to, loss of revenue, profits, data, or opportunities) which you might incur as a result of using our service.

6.3 Workshop information can be altered or otherwise updated at any time. We will attempt to ensure all information is appropriately accurate at the date of publication. We retain, however, no responsibility for the changing of information, key or otherwise, through your period of use, and we are not liable for any consequential losses as a result of these changes.

6.4 We will not be held liable for any issues arising from difficulty accessing our online platform due to faults in your internet connection, your network, or any other accessories and equipment necessary.

6.5 We reserve the right to amend and alter pricing, information, and any workshop materials at our convenience without prior notice.

7. Personal Data Usage

7.1 Any of your personal data collected during your period of use is only ever going to be used in strict accordance with the Data Protection Act 2018. We will take all appropriate and necessary measures to ensure your data is kept secure. Your personal information can only be shared with third parties with your direct permission. However, we reserve the right to use your contact information to contact you with promotions or information relating to Workshops.

7.2 Any data you provide can be used for the provision of credit reports, to prevent fraud and money laundering, or to otherwise confirm your identity.

8. Governing Law

These terms and conditions and any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way relation to the Workshops, your account or the terms and conditions (including any non-contractual disputes or claims), shall be governed by and construed in accordance with English Law.
